What this privacy  policy covers

This Privacy Policy (“Policy”) outlines how Eight Medical Inc. (“Eight Medical Inc,” “we,” or “us”) collects personal information from or about you, how we may use or disclose that personal information, rights you may have to control our use of personal information, and how to exercise those rights. The Policy is applicable worldwide. This Policy is incorporated into and is subject to the Eight Medical Inc Terms of Use. Capitalized terms used but not defined in this Policy have the meaning given to them in the Eight Medical Terms of Use.

As used in this Privacy Policy, “personal information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. It may include, but is not limited to, name, email address, postal or other physical address, credit or debit card number, title, and other information linked to a persistent identifier assigned or linkable to an individual.

This Policy may be updated from time to time to reflect changes in EightMedical’ operational practices or regulatory requirements. If we make any material changes, we will post an updated Policy to EightMedical.co and provide you with notice via reasonable means, such as by emailing individuals who have registered with us and/or providing a notice on the EightMedical website. We encourage you to periodically review this page for the latest information on our privacy practices.

EightMedical collects personal information both in connection with providing Emergency-Related Services and from individuals who interact with us using Non-Emergency Channels.  As explained in more detail below, EightMedical’s personal information collection and usage practices differ depending on the source and nature of the information involved. EightMedical recognizes the value of user privacy, particularly as it relates to the sensitive information we collect as a necessary part of providing Emergency-Related Services. We take the privacy of all user information seriously.

Emergency-Related Services

EightMedicals’ mission is to offer products and services that enhance and provide emergency,  emergency-related, emergency-preparedness-related, between members of the public and Eight Emergency Service Responders. We collect certain forms of personal information in connection with running our Emergency Services. We only use the personal information that we collect in connection with our Emergency Services for the limited purposes and for the limited time period described below.  We do not sell this information. 

 

How we collect personal information

The personal information that we collect through our Emergency Services comes from several sources.  If you have an EightMedical account, we collect personal information from you when you provide it to us and when you use your EightMedical account.

We may also receive information about you or your household directly from Emergency Service Providers or Responders, from our Computer-Aided Dispatch System and from other organizations that work with or assist Emergency Service Providers. We also collect this personal information from cell phones and other devices on which EightMedical software is installed and working (“Connected Devices”). If your Connected Device is used to call 08098888763 or otherwise contact an Emergency Service Provider, EightMedical may attempt to automatically transmit information from your device that may assist the Emergency Service Provider or Responder in directing appropriate and timely assistance to you. This process will involve our collection and temporary retention of personal information derived from Emergency or Emergency Related Services.  Connected Devices are designed to automatically transmit personal information to EightMedical when that device is used to communicate with an Emergency Service Provider. 

How might EightMedical powered software wind up on your device?  EightMedical provides Emergency Services, Emergency-Related Services to application, platform, operating system, and software developers (our “Partners”) who build EightMedical functionality into their applications, platforms, operating systems, or software in order to better help device users connect with Emergency Service Providers or Responders in an emergency. We provide Emergency Services, Emergency-Related Services to and for our Partners pursuant to agreements strictly controlling our collection and use of personal information. EightMedical  may also offer Emergency Services or Emergency-Related Services directly to members of the public through an application, platform, emergency-related web portal, software, or otherwise, and you may choose to download, install, or operate one of these services.

Emergency-Related Services: Categories of Personal Information

If your Connected Device is used to contact a Public Safety Answering Point or Emergency Service Provider, we may collect the following categories of personal information associated with the device:

  • Information that directly identifies the owner or customary user of the device, such as your name, physical address, email address, and phone number.
  • Health information, medical information, and any other information that you have on your Connected Device and that you have indicated (through settings on your device, device accounts, or otherwise) should be shared with emergency responders.
  • Precise geolocation of the Connected Device.
  • Information about the Connected Device’s configuration, network, and internet connection, such as IP address(es), MAC address, other device ID (UDID), device type, operating system type and version, and client version.

 

We retain personal information collected from a Connected Device for the brief period during which it will be of use to Emergency Service Providers, Responders, and Hospitals.

If you have an Eight Medical account, we may collect the following categories of personal information:

  • Information that directly identifies you, such as your username, name, physical address, email address, and phone number.
  • Information about your use of your RapidSOS account.
  • Information about the device(s) used to access your RapidSOS account, including configuration, network, and an internet connection, such as geolocation, IP address(es), MAC address, other device ID (UDID), device type, operating system type and version, and client version.

Emergency-Related Services: Use of personal information

We may use all of the categories of personal information that we collect in connection with our Emergency Services or  emergency-related Services to operate, maintain, enhance, support, and provide all features of our Emergency Services or emergency-related Services, in connection with protecting our legal rights, and as otherwise required by law. For example, we use personal information to:

  • Supplement and optimize our system functionality with more accurate geolocation information.
  • Transmit potentially life-saving health information.
  • Authenticate and communicate with registered Emergency Service Providers or responders who provide Emergency services or access our emergency-related Services.
  • Conduct quality assurance for research and development purposes, such as data security, improved website navigation, and content display, fraud prevention, data analysis, audits, development of new products, producing predictive data models, improving our Emergency Services or emergency-related Services, identifying usage trends, and determining the effectiveness of our Emergency or Emergency Related Services.

We do not use personal information collected through emergency-related Services, including information collected from Emergency Service Providers, Computer-Aided Dispatch System providers, other organizations that work with or assist Emergency Service Providers, or Connected Devices, for advertising purposes.

 

Emergency-Related Services: Sharing personal information

We may disclose all of the categories of personal information collected through Emergency or Emergency Related Services only as reasonably necessary to provide our Emergency or Emergency Related Services, protect our legal rights, and comply with applicable law.

To these ends, we may disclose your personal information to the following categories of third parties:

    • Emergency Service Providers. We share personal information with Emergency Service Providers or Responders in order to enhance emergency response, facilitate communication during an emergency, and facilitate emergency-preparedness-related communication.
    • Our service providers or responders. Our service providers may receive access to personal information as part of helping to offer our Services and operate EightMedical. Our service providers are contractually required to keep this information confidential and secure and are prohibited from using this data for any purpose other than carrying out the services that they are performing for us.
  • Our Partners (personal information collected from Connected Devices only). If you are the user of a Connected Device, your device has an app, platform, operating system, or piece of software installed on it that is offered by one of our Partners, and that incorporates EightMedical functionality. When we collect information from a Connected Device to provide Emergency or Emergency Related Services, we are collecting that information on behalf of the relevant Partner, pursuant to contracts that require us to safeguard this information and to only use it in order to provide our Services. 
  • As with all personal information collected from your device by or on behalf of the Partner, the Partner may access, use, share, or otherwise process this information in accordance with the Partner’s own privacy policy. We do not control our Partner’s use of any personal information that they directly or indirectly collect as part of offering their app, platform, operating system, or software. If you have questions about our Partner’s privacy practices, we will refer you to our Partner.
  • Entity related to corporate reorganization. We may disclose personal information in connection with any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

EightMedical does not sell personal information collected through Emergency or Emergency Related Services.

Our general information website and other non-emergency products and services

EightMedical also collects personal information from and about visitors to our general information website, 8medical.co, or any other website that we use for general information and marketing purposes, and not for the provision of any Emergency-Related Service (“Non-Emergency Site”), companies, individuals, and Emergency Service Personnel who have asked for information about partnering with, using, promoting, or otherwise interacting with Eight  medical services; and other individuals who interact with Eightmedical using means other than our Emergency or Emergency Related Services (collectively, “Non-Emergency Channels”). We collect personal information through Non-Emergency Channels using standard business and data collection techniques.

 

Non-Emergency Channels: How we collect personal information

We will collect personal information from or about you through Non-Emergency Channels if you actively give personal information to us in a non-emergency context (for example, if you sign up for our newsletter or ask us to send you information about EightMedical. We may also automatically collect personal information from you or your device when you visit a Non-Emergency Site, interact with advertisements for EightMedical services, or interact with non-emergency communications from or about EightMedical.

We may also collect personal information from publicly available sources and third-party databases. We do not combine information that we collect through Non-Emergency Channels with information we collect in connection with our emergency-related services.

 

Non-Emergency Channels: Categories of Personal Information

We may collect the following categories of personal information from you or about you through Non-Emergency Channels:

  • Information that directly identifies you or your households, such as your name, physical address, email address, and phone number.
  • Information about your device, network, and internet connection, such as your IP address(es), MAC address, other device ID (UDID), device type, operating system type and version, and client version.
  • Information about your use of our Non-Emergency Site, such as the pages you most commonly visit.
  • Information regarding your interaction with email messages or other communications regarding EightMedical such as whether you opened, clicked on, or forwarded a message.
  • Your business or employment information
  • Your geolocation, if you have enabled sharing from your device
  • Other personal information, including inferences that can be drawn from the foregoing

Non-Emergency Channels: Use of personal information

We may use all of the categories of personal information that we collect through Emergency or Non-Emergency Channels to operate, maintain, enhance, support, and provide our website, marketing, and advertising for services offered by EightMedical or our affiliates, in connection with protecting our legal rights, for research and analytics purposes, and as otherwise required by law.

 

Non-Emergency Channels: Sharing and sale of personal information

We may disclose all of the categories of personal information listed above to our service providers and third parties for the purposes of running our business and offering our Non-Emergency Site and any non-emergency services.

EightMedical does not “sell” any personal information in the traditional sense.  However, we do allow certain third-party partners and providers to collect information about visitors to our Non-Emergency Site for purposes of analyzing and optimizing our services, delivering ads, providing content and ads that are more relevant, measuring statistics, and the success of ad campaigns, and detecting and reporting fraud. To the extent this practice is interpreted to constitute a “sale” of personal information under the Delaware Consumer Privacy Act or any equivalent data protection law, you have the right to opt out of such sharing at any time. EightMedical will not engage in any discriminatory or retaliatory action against you if you choose to opt-out of such sharing.  We do not allow third-parties to gather personal information from our Emergency-Related Services for analytics or advertising purposes.

 

Third-Party Links and Services

We may place third-party buttons on our Site that allow you to easily share or integrate EightMedical materials into a third-party service (such as Facebook “like” or “share” buttons). If you click on such a button, you are voluntarily and affirmatively interacting with that third-party service, and you may be directly sharing personal information with that third party. Any personal information collected by such a third-party service is governed entirely by the relevant third party’s own data collection, use, and disclosure policies, not this Privacy Policy.

We do our best to offer individuals choices and control over their own personal information. This section explains your rights and some of our responsibilities to help you.

Your Rights

This section explains your rights and some of our responsibilities to help you. Get an electronic or paper copy of your medical record. You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you.

Ask us how to do this. We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable, cost-based fee.

Ask us to correct your medical record You can ask us to correct health information about you that you think is incorrect or incomplete.

If you pay for a service or health care item out-of-pocket in full, you can ask us not to share that information for the purpose of payment or our operations with your health insurer. Get a list of those with whom we’ve shared information You can ask for a list (accounting) of the times we’ve shared your health information for six years prior to the date you ask, who we shared it with, and why. Your Choices

For certain health information, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations described below, talk to us. Tell us what you want us to do, and we will follow your instructions.

In these cases, you have both the right and choice to tell us to:

Share information with your family, close friends, or others involved in your care, share information in a disaster relief situation Include your information in a hospital directory. If you are not able to tell us your preference, for example, if you are unconscious, we may go ahead and share your information if we believe it is in your best interest. Our Uses and Disclosures

How do we typically use or share your health information?

  • We typically use or share your health information in the following ways. Treat you we can use your health information and share it with other professionals who are treating you.
  • Run our organization We can use and share your health information to run our practice, improve your care, and contact you when necessary.
  • Bill for your services. We can use and share your health information to bill and get payment from health plans or other entities. How else can we use or share your health information?

  • For special government functions such as military, national security, and presidential protective services

Our Responsibilities

We are required by law to maintain the privacy and security of your protected health information.

We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.
We must follow the duties and privacy practices described in this notice and give you a copy of it.
